If the purchase is being made through a Real Estate Agent, he will be the one who can inform you of the situation of the home, the procedures and the documentation that you must provide. Otherwise you should know the prior checks essential for the successful completion of the operation.

THE CITY COUNCIL

One of the prior information is check the housing situation in urban planning terms. The aim is to consult whether future urban plans pending approval, in the public consultation or execution phase, may affect the home or its environment, altering the circumstances that influence its decision.

EL PROPERTY REGISTRY

It is a public and official file where all acts and contracts related to property and other rights over real estate are recorded.

The Registry identifies who the current owner is and if the property is encumbered with a mortgage or with some other right, such as seizure notes, resolutory conditions, usufruct rights, leases, purchase options, etc.

You must ensure that the home is free of charges, that is, up to date with payments of taxes, fees, censuses, judicial seizures, etc.

If the home It is encumbered with a mortgage in which it does not want to be subrogated or with any other charge, the seller must pay it financially and registrarily before signing.

COMMUNITY OF OWNERS

You must request through the administrator of the property or the community of owners the certificate that certifies that the home is up to date with the payments to the community.

The Notary must state that such certificate is provided. In this way, owners who are delinquent with the community are prevented from selling without paying these debts.

Find out if there are any planned spills for extraordinary expenses, any work or rehabilitation, elevator, façade, etc. that entails future expenses that are an obligation for which the home is responsible regardless of who the owner is.

You must also take into account the monthly community expense and the number of neighbors.

TAXES AND HOUSING

Homes pay taxes, or rather, their owners pay them. It is important to know the payment situation of the Real Estate Tax (IBI). Check that you are up to date with payments since the home is responsible for the last two immediate annuities. The cadastral reference is mandatory in the deed and, in any case, is necessary for registration in the Registry.

DOCUMENTATION TO REVIEW BEFORE FORMALIZING THE PURCHASE

If the home you want to buy is second-hand, before buying you will have to review the following documentation:

1. Transferor’s property title.

2. Last annual IBI receipt (Real Estate Tax or Urban Contribution).

3. Community owners certificate proving that the seller is up to date with payment of community expenses.

4. Ownership and burden status of the home (Simple Note from the Property Registry).

5. Latest service receipts up to date with payment: water, electricity, gas, etc.

6. ITE, Technical Building Inspection, regulates the conservation of properties. Mandatory in some Autonomous Communities, in homes over 20 years old.

If you buy a home on sale, the information available varies a little since the community of owners does not exist, which is usually established once all homes delivered. There is also no IBI, and only the parent property can appear in the Registry, without identifying each of the homes since the developer has not yet carried out the Horizontal Division.

1. Name or company name of the promoter, address and registration data in the Commercial Registry.

2. Location plans of the property and home.

3. Description of the home: useful area, services and supplies, common areas, security measures, etc.

4. Quality memory.

5. Property registration data in the Property Registry.

6. Contract with its general and special conditions (price, payment method, delivery time…).
